Permit rules by Maryland county and city

Requirements vary significantly depending on where your property sits. Find your area below.

Montgomery County

Home to some of the strictest tree regulations in the state. The county Tree Canopy Law requires developers and property owners to plant shade trees or pay a mitigation fee. Removal permits often require replanting or payment into the Street Tree Planting Fund when obtained alongside sediment control permits.

Baltimore County & Baltimore City

Rules vary between suburban Baltimore County and Baltimore City itself. Urban lots in the city often require additional coordination for equipment access, which can affect permit timing and street closures.

Anne Arundel County

Heavily regulated by the Chesapeake Bay Critical Area Commission. Properties near shorelines or waterways face stricter permitting and review processes for any vegetation removal.

Howard County

Many properties fall under HOA governance in addition to county rules. Columbia residents in particular should check both HOA guidelines and county permits before scheduling removal.

Prince George’s County

Critical Area rules apply near water. Properties outside those zones generally have more straightforward permitting for standard removals.

Takoma Park

One of the strictest municipalities in Maryland. A permit is required for nearly any urban tree over 7 and 5/8 inches in diameter, and removing more than 10 trees requires a public hearing.

Chevy Chase Village

Any tree over 24 inches in circumference requires a permit. If denied, the village can require reforestation plans or impose fines of $750 per tree removed illegally.

Frederick, Carroll, Harford & Charles Counties

Generally more permissive for standard residential removals, though Critical Area and forest conservation rules still apply if you live near protected land or waterways.

The Roadside Tree Law of 1914

Enacted over a century ago, this law states that any tree, or part of one, growing in a public right-of-way requires a DNR permit before pruning or removal. Work must be performed by a Licensed Tree Expert.

Neighbor Trees & Insurance

If a neighbor tree falls on my house, who pays? Under Maryland law, a healthy tree falling during a storm is an Act of God. You file the claim with your own insurance regardless of whose yard the tree grew in.

Most policies cover removal only after a tree damages an insured structure, not as preventative maintenance.

Chesapeake Bay Critical Area

Properties generally within 1,000 feet of tidal waters face additional permitting through county-level Critical Area Commissions before any vegetation removal, including dead trees.

This heavily affects Anne Arundel, Prince George’s, and other waterfront counties in Maryland.
